Latimer Farm – Rental Terms & Conditions

1. Contract

1.1 These Rental Terms and Conditions (“Rental Terms”) form a legally binding agreement between the Owner of Latimer Farm (“the Owner”, “we”, “us”, “our”) and the lead guest making the booking (“the Guest”, “you”).

1.2 A contract is formed once the Guest has made the first payment and a booking confirmation has been issued via the Lodgify platform.

1.3 The Guest is responsible for ensuring that all members of their party comply with these Rental Terms and the Property Rules.

1.4 This agreement does not create a landlord and tenant relationship, nor does it constitute an assured shorthold tenancy or any other form of tenancy.

2. Rental Period

2.1 The Property is let for short-term holiday accommodation only.

2.2 The rental period is limited to the dates confirmed in the booking confirmation.

2.3 Check-in is from 4:00pm on the arrival date.
Check-out is no later than 10:00am on the departure date.

2.4 Late departure may result in additional charges.

3. Payment Terms

3.1 The total rental price shall be paid in two instalments:

• 50% of the reservation total payable at the time of booking
• The remaining balance payable no later than 60 days before arrival

3.2 All payments are processed via the Lodgify platform.

3.3 Failure to pay the remaining balance by the due date may result in cancellation of the booking without refund.

4. Cancellation by the Guest

4.1 All bookings are strictly non-refundable.

4.2 If the Guest cancels the booking at any time:

• Any amounts already paid shall be retained in full
• Any unpaid remaining balance shall not be charged

4.3 No refunds are given for early departure, late arrival, no-shows, or changes in personal circumstances.

4.4 The Guest is advised to obtain appropriate travel insurance.

5. Cancellation by the Owner

5.1 The Owner reserves the right to cancel the booking if the Property becomes unavailable due to events beyond reasonable control.

5.2 In such circumstances, the Owner’s liability is limited to a refund of any amounts already paid.

6. Security Deposit

6.1 A security deposit is required for all bookings.

6.2 The security deposit is pre-authorised on the Guest’s credit or debit card via Lodgify.

6.3 The amount of the security deposit is 10% of the total reservation amount.

6.4 The pre-authorisation is applied 1 day prior to arrival.

6.5 The Owner may claim against the deposit for:

• Damage to the Property or contents
• Excessive or specialist cleaning
• Missing items
• Breach of these Rental Terms or the Property Rules

6.6 The pre-authorisation will be released within 2 days after departure, provided no claim is made.

6.7 The Guest remains liable for costs exceeding the security deposit amount.

7. Use of the Property

7.1 The Property may only be used for private holiday accommodation.

7.2 The maximum occupancy stated in the booking confirmation must not be exceeded.

7.3 Events, parties, functions, or commercial use are strictly prohibited without prior written consent.

7.4 The Guest is responsible for the conduct of all persons at the Property.

8. Property Rules

8.1 The Guest agrees to comply with the Property Rules set out in Schedule 1, which form part of these Rental Terms.

9. Right of Entry

9.1 The Owner or authorised representatives may enter the Property at reasonable times for maintenance, inspection, or emergencies.

10. Liability

10.1 The Owner is responsible for foreseeable loss caused by negligence.

10.2 The Owner is not liable for loss or damage to personal belongings or vehicles.

10.3 The Owner is not liable for indirect or consequential losses.

10.4 Nothing in these terms limits liability for death, personal injury, fraud, or fraudulent misrepresentation.

11. Termination

11.1 The Owner may terminate the booking without refund in the event of a serious breach, including but not limited to:

• Excessive noise
• Over-occupancy
• Illegal activity
• Misrepresentation of booking purpose
• Breach of the Property Rules

12. Quote Expiry

12.1 Booking quotes are valid for 48 hours only.

13. Governing Law

13.1 These Rental Terms are governed by English law, and the courts of England and Wales shall have exclusive jurisdiction.

Schedule 1 – Property Rules (Latimer Farm)

These Property Rules form part of the Rental Terms and are designed to ensure the safe enjoyment of the Property, to protect the Property and its contents, and to respect neighbouring properties.

Failure to comply may result in deductions from the security deposit and/or termination of the booking in accordance with Clause 11.

1. General Conduct

1.1 The Property is a private home and must be treated with care and respect at all times.

1.2 The Guest is responsible for the behaviour of all members of their party and any visitors.

2. Occupancy & Use

2.1 The maximum number of overnight guests permitted at the Property is 20 persons, unless otherwise agreed in writing.

2.2 The total number of persons at the Property (including day visitors) must not exceed 20 persons at any time without prior written approval.

2.3 Any gathering exceeding this number must be agreed in advance and may be subject to additional charges and conditions.

2.4 The Property may not be used for:

• Events
• Parties
• Commercial purposes
  without prior written consent.

3. Children

3.1 Children must be supervised at all times.

3.2 Guests accept full responsibility for their safety.

4. Swimming Pool

4.1 Use of the pool is at the Guest’s own risk.

4.2 Children must be supervised at all times.

4.3 Diving and jumping are not permitted.

4.4 The pool cover must be closed when not in use and overnight.

4.5 The pool is seasonal and may not always be available.

5. Tennis Court

5.1 Use is at the Guest’s own risk.

5.2 Appropriate footwear must be used; no mud permitted.

5.3 Alternative uses require approval.

6. Noise

6.1 Noise must be kept to a minimum.

6.2 No music outside.

6.3 Noise must not be audible externally.

6.4 Doors and windows (except bedrooms) must be closed from 10:00pm.

7. Rubbish

7.1 Waste must be disposed of in accordance with the House Guide.

7.2 Recycling must be separated appropriately.

8. Dogs

8.1 One well-behaved dog permitted with approval.

8.2 Dogs:

• Not on furniture
• Not upstairs or in bedrooms
• Must sleep in designated areas

9. Smoking

9.1 Smoking is prohibited inside or in covered areas.

10. Fireworks & Drones

10.1 Fireworks are prohibited.
10.2 Drones are prohibited.

11. Decorations & Equipment

11.1 No external equipment or decorations without approval.

12. Guest Staff

12.1 Must be approved and supervised.
12.2 Guests are responsible for their conduct.

13. Security

13.1 Doors, windows, and gates must be secured at all times.

13.2 Alarm systems must be activated when leaving.

14. Fire Safety

14.1 Candles must not be left unattended.

14.2 Fires must be properly managed and extinguished.

15. Property Care

15.1 Guests must take care with products that may stain or damage materials.

15.2 Damage may result in replacement charges.

16. Weapons

16.1 No weapons permitted without prior written consent.

17. Social Media

17.1 Guests must not disclose or geo-tag the exact location of the Property.

18. Facilities

18.1 Use of all facilities is at the Guest’s own risk.

18.2 Guests must follow all instructions provided.
